On November 14, 1959, at about 5:15 a. m., the plaintiff, Joseph J. La Vallie, together with his brother and one Clarence
Martin, left Chicago on a deer hunting trip. The plaintiff's brother drove his own 1957 Pontiac sedan from Chicago to Milwaukee.
The plaintiff drove from the time they left Milwaukee until they reached the scene of the accident, which occurred on highway
57, about five miles north of Plymouth, Wisconsin. Winter driving conditions prevailed. It had snowed the night before, and highway 57 was icy and slippery. At the scene of
this accident, highway 57 runs north and south the is generally level; it is 24 feet wide and is surfaced with concrete. The
temperature was between 30 and 40 degrees.
