An action by Joseph Kuzel to recover damages for injuries sustained on May 25, 1958, when a car driven by Ronald Dewey, in
which Kuzel was a passenger, collided head-on with an automobile driven by William Janz, deceased, an insured of the State
Farm Mutual Automobile Insurance Company. Trial was had to the court and jury. The jury found both Janz and Dewey causally negligent in the operation of their vehicles.
The negligence was apportioned 10 percent to Janz and 90 percent to Dewey, and Kuzel's total damages were found to be $45,328.65.
In an addendum to the special verdict, the trial court held as a matter of law that plaintiff Kuzel and the driver Dewey were
engaged in a joint enterprise or partnership at the time of the collision, and that Dewey's negligence was imputed to Kuzel.
